Important: Rental restrictions are set by individual HOAs and can change. This guide reflects policies as of June 2026. Always verify current rules directly with the building's HOA before purchasing for investment purposes. City of Miami Beach prohibits STRs in most residential zones regardless of building policy.

Which Miami condos allow Airbnb? Only buildings whose condominium documents permit stays under 30 days, in a city zone that allows short-term rentals. Owners also need a Florida DBPR vacation rental license, a local certificate of use or business tax receipt, and a tourist tax account. New buildings whose developers state no rental restrictions include The Rider in Wynwood.

A rental decision has separate building, city and state steps. Start with the association's current written declaration and rental policy, then confirm the permitted use for the precise address with the local government. A city approval does not change a condominium's minimum lease term, lease limit or registration process. Likewise, a building rule does not replace licensing, tax registration or any municipal requirement that applies to the unit. Retain written copies of every applicable response before making an offer.

Ask for the documents early in the offer process. A complete request normally includes the declaration and amendments, association rules, current budget, rental application, lease-registration form, move-in schedule and any policy covering guests or platform stays. Compare the exact wording with the unit's proposed use. A rule that permits an annual lease does not by itself permit monthly, weekly or nightly occupancy. The association's management company can explain its present process, but the written documents are the record to retain with the purchase file.

Local approvals should also be reviewed by address, not just by neighborhood. Municipal requirements can depend on the property's zoning, building classification and operating model. Before listing a residence, confirm which registrations are required, when they must be renewed, whether a local contact is needed and how tourist or resort taxes are handled. Keep the condominium approval, government registrations and insurance information together. A prospective guest's reservation date should never be used as the deadline for determining whether the home can lawfully be offered.

If a resale listing advertises rental flexibility, ask which document supports the statement and when that document was last updated. Marketing language is not a substitute for the declaration, policy or municipal confirmation. Save the response with the listing records, and repeat the check if the intended lease term changes before closing.

How to check if a Miami condo allows Airbnb

  1. Ask the association for the current declaration, rules, amendment history and a written rental policy. Read the minimum lease term, the number of leases permitted each year, registration rules, application fees and any waiting period after purchase.
  2. Check the address with the relevant local government. Miami Beach and the City of Miami apply different zoning, registration and enforcement rules.
  3. Confirm the state and local licensing path before you close. A building may allow rentals while a specific unit, zone or operator has additional requirements.

If the answer is unclear, treat the unit as long-term rental only until the association and local jurisdiction confirm otherwise in writing.

Buildings with rental restrictions

The building cards below organize the available policy information by building. Use them as a starting point, then obtain the current association documents before making an offer. Policies can change through an amendment, board rule or municipal enforcement action.

Short-term rental permitted

A published policy indicates short stays may be permitted. Confirm the declaration, municipal rules and operator requirements.

Minimum term or limits

The association may require a minimum term, cap leases or limit leases per year. Check the current written rule.

Not established

No short-term rental conclusion should be drawn without current association and local-government confirmation.

Licenses and taxes before you list

A condo owner may need a Florida DBPR vacation-rental license, a local certificate or registration, a business tax receipt and state/county tax registrations. The City of Miami publishes a checklist for qualifying lodging uses. Use the governmental links above and verify the requirements that apply to the precise address and operating model.

How rental rules affect condo resale value

Rental flexibility can broaden the buyer pool, while a longer minimum term can favor owners seeking a quieter residential environment. Neither outcome guarantees price appreciation. Compare active listings, recent closed sales, association fees, reserve obligations and the published rental policy for the specific building.
